Source title: New rules for teachers to discipline students against 7 types of behavior will be implemented on March 1
For a long time, there has been controversy over where the line is between educational discipline and punishment. Recently, the Ministry of Education promulgated the “Elementary and Secondary School Educational Disciplinary Rules (Trial)”. This rule defines educational discipline for the first time, stipulating that schools and teachers can disobey management, disrupt order, smoke, drink, anomie, and infringe on rights and interests. In such circumstances, educational punishment will be carried out, but the execution of educational punishment will not include corporal punishment such as hitting, piercing, punishment station exceeding the normal limit, and deliberate isolation or other acts of corporal punishment. The new regulations will be implemented on March 1 of next year.
According to the “Rules”, educational discipline is the management, training or correction of students who violate regulations and disciplines for educational purposes by schools and teachers, in order to encourage students to take warning, recognize and correct inappropriate educational behaviors. Educational discipline is not a punishment, but a form of education.
Under what circumstances can educational punishment be implemented? The “Rules” clarify that the school and its teachers must detain and educate students in one of the following situations. If really necessary, they can implement an educational punishment: deliberately failing to complete the teaching assignment or disobeying education or administration; disrupt the classroom Order, school education and teaching order; smoking, drinking, or abusive behavior in violation of the student code; committing dangerous behaviors that are harmful to the physical and mental health of oneself or others; hitting and scolding classmates, teachers, intimidating classmates or infringing on the legal rights and interests of others; and other violations School rules and disciplines. In addition, if students commit misconduct or serious misconduct stipulated in the Juvenile Crimes Prevention Act, schools and teachers must stop them and implement educational penalties and strengthen discipline; If they constitute a crime, they will be transferred to the public security organs for their handling.
According to the degree of severity, the “Rules” divide educational discipline into three categories: general educational discipline, heavier educational discipline, and severe educational discipline. General education sanctions apply to students with minor infractions of rules and disciplines, including naming criticism, oral or written reviews, adding additional teaching or public service assignments to the class, staying in the classroom for a period of time. classroom teaching, after-school teaching, etc .; more emphasis on education Disciplinary discipline applies to students who have serious violations of the rules and disciplines or who refuse to be corrected through education and discipline on the spot, including training of the person in charge of moral education, performing public services at school, receiving special school rules, school discipline and education in rules of conduct, suspension or restriction of participation in tours, and other group activities, etc .; Serious educational penalties apply to students who violate regulations and disciplines with serious or severe impact, and must be students in the upper grades of elementary, middle, and high school, including suspension from school and suspension from school, advice from the deputy director of the rule of law or advisor on the rule of law, and advice and correction by specialized personnel.
The “Rules” propose that educational punishment and corporal punishment and disguised corporal punishment are acts of a different nature, and seven types of inappropriate educational conduct are clearly prohibited.
7 types of inappropriate educational behavior
■ Physical punishment that directly causes physical pain by hitting, punching, etc.
■ Punishment beyond normal limits, repeated copying, forcing awkward movements or postures, and deliberate isolation and other disguised physical punishment that indirectly harms the body or mind.
