After the approval of the Chamber of Deputies and Deputies and the Senate, on Thursday night the National Congress it dispatched the project that allows a second withdrawal of pension funds from the AFPs presented by the Government.
In this way, President Sebastián Piñera will have a maximum period of five days to promulgate the initiative, so that later it is taken by reason by the Comptroller General of the Republic (CGR) and thus finally, become the Law of the Republic after being published in the Official diary.
Fundamental points of the project
- All affiliatesExcept for the high authorities, they may request the second withdrawal of pension funds from the AFPs.
- Amount to withdraw: 10% of the funds or a maximum of 150 UF ($ 4.3 million).
- If 100% of the accumulated funds is less than 35 UF ($ 1 million), the entire fund can be withdrawn, otherwise:
– First installment: In 10 business days from the request, 50% of what is required can be withdrawn.
– Second installment: The remaining 50% will be delivered within a maximum period of 10 business days from the previous withdrawal. - Withdrawal may be requested up to one year after the law is published in the Official Gazette.
- No tax payment for monthly income less than $ 1.5 million.
- There will be no mandatory refund of the amount requested by the member.
- Alimony pensions: The Family Judge will authorize the minor (or his legal representative) to request the delinquent obligor to withdraw funds up to the entire debt..
