You are in a delicate financial situation these days Álvaro Castro Robles (50), commercial engineer from the University of Santiago de Chile (Usach), owner of Best Quality Products SpA, a company that imports products from China that is on the verge of bankruptcy. The reason? The businessman sold a series of boxes of N95 masks, gloves and thermometers to the Chilean Association of Popular Pharmacies (Achifarp) in the middle of last year and still does not receive the promised payments.

Given the refusal, on March 5, 2021, Álvaro Castro filed a complaint for fraud against the president of the group that brings together the municipalities and whose board of directors is chaired by the mayor of Recoleta, Daniel Jadue Jadue (PC).

“It is necessary to emphasize at this point our bewilderment and amazement at what we consider today a millionaire fraud that has us on the verge of bankruptcy, with problems with the Internal Revenue Service due to non-payment of VAT, with Chinese suppliers demanding insistently the payment of the merchandise that we import, among other serious inconveniences to which we have been exposed due to this damage, which today amounts to the sum of $ 961,667,273. This figure is obtained when considering that the total sales made to Achifarp was $ 1,384,817,875, an amount to which the sum of $ 185,555,660 must be deducted for isolated and infrequent payments by the aforementioned association, and then deduct $ 237,594,942 for the concept of factoring”, Concluded the criminal action.

The problem for Álvaro Castro began when in June 2020 he was contacted by Matías Muñoz – at that time he was an official of the Municipality of Recoleta and today he is executive secretary of Achifarp – who tells him that the mayor of Recoleta, Daniel Jadue, was interested in buying their products in order to “urgently supply” the Popular Pharmacies.

“Mr. Jadue made us trust us by using his public image with the sole purpose of obtaining that we sell our merchandise to him, which we do in good faith, thus achieving the patrimonial disposition of our supplies, which were received without any claim and that today they continue to sell as can be seen both in their own branches and also on Achifarp’s own website https://www.achifarpchile.cl/, which has allowed them to profit from our merchandise, ”the criminal action stated.

The Third PM He consulted the mayor of Recoleta, Daniel Jadue, on this matter and declined to comment. Likewise, the question was posed to the current executive secretary of Achifarp, Matías Muñoz, and he said that he was preparing a public statement on the criminal action. When contacted the vice president of the group, Germán Codina, mayor of Puente Alto, said he was not aware of the case.

Another problem came when he tried to cash a check signed by the mayor himself for more than $ 100 million and had no funds. However, the communal chief “asked us not to collect it yet, since he had no funds. The judicial action was declared admissible and today the investigation is in the hands of the prosecutor Giovanna Herrera, from the North Central Zone, who has already issued an order to investigate the PDI.

“During the month of June of the year 2020 we exchanged calls and achieved various meetings between my salespeople and the intermediary Mr. Matías Muñoz, who in the first instance and with the knowledge and approval of Daniel Jadue, made the pertinent links with municipal personnel and we were able to make a first sale directly with the Municipality of Recoleta ”, stated Castro in the complaint that is sponsored by the study Lagos & Asociados.

In the criminal action, the businessman said that he later met with the communal chief of Recoleta, who not only expressed interest in obtaining supplies at the communal level with his products, but also indicated that this would be just the beginning as a hitch or commercial attraction. , since the operation would open the doors for the conglomerate “Popular Pharmacies, which is in full swing and frank expansion.”

“He also tells us that new projects would soon be developed along the same lines and together with the Association of Mayors, keeping in mind the creation, for example, of the Popular Supermarkets, and that we were in the best of conditions to get on board such projects, both current and future. This was what he made us believe and what he appeared to make us have the requested merchandise, always taking refuge in the lucrative slogan of Popular Pharmacies and its reception at the country level, ”Castro explained in the complaint.

At the end of the meeting, the communal chief asked him to continue negotiating with the then executive secretary, Mr. Raúl Daniel Moraga Lagarrigue, who is currently a candidate for mayor of the Communist Party in the Peñalolén commune.

The first sale of Best Quality was made directly to the Municipality of Recoleta, based on Quote No. 1781 of June 18, 2020, without having a purchase order, but only at the verbal request of Daniel Jadue as a requesting party. This purchase is associated with invoice No. 202 dated June 30, 2020 and has already been paid.

After the first business, it began to manage purchase orders with the Achifarp and no longer with the Municipality of Recoleta, generating a total of 11 invoices to the group and one to the municipality. The invoices were processed from July 1, 2020 to November 10, 2020 and were from
$ 13,328,000 to $ 345,100,000.

“From this point on, we only received excuses from Mr. Moraga, promises of payment and requests for payment facilities, without having seen a weight, while Best Quality continued to fulfill its obligations permanently and fully. We went to the defendant Jadue in search of concrete answers, who began to avoid us constantly, sometimes justifying his political activity and other times without giving any reason, “he explained in the complaint.

The case is heard in the 8th Guarantee Court of Santiago and the prosecutor Giovanna Herrera is in charge of the investigation, who has extensive experience in highly complex investigations.
