Chamber approves bill suspending loan installments for 6 months

The Chamber of Deputies approved by 109 votes in favor, 6 against and 24 abstentions the bill that suspends the collection of loan installments of various types for the duration of the constitutional state of emergency of catastrophe.

In this way, the text was sent to the Senate for its second constitutional process.

The rule benefits individuals and SMEs, which will have the right to request the suspension of the payment of six installments of credits of any nature, subscribed with institutions with access to the Liquidity Facility with Credit Incentive from the Central Bank and for the amount granted by it.

In the session, the parliamentarians approved the second report of the Economy Commission, which rejected the substitute indication proposed by the Government, which intended to limit this suspension benefit only to the mortgage loan installments.

Likewise, the chamber voted against an indication of the Finance Commission, which eliminated the possibility of availing themselves of this benefit to people who have contracted financing credits to study higher education administered by Corfo. On this point, the deputy Sofía Cid (RN) requested constitutionality reservation, as this matter corresponds, in her opinion, to an exclusive attribution of the Executive.

In this way, to make effective the benefit of suspending the payment for six months, the credit operation cannot be in default prior to October 18, 2019.

It is also established that the agreed installments must be paid at the end of the debt, in the same number of installments, readjusted to the interest rate previously agreed on the loan.

The text indicates that no charge may be made for late payment, fine or any other type of additional charge.

The institution will have a period of five banking business days to respond to the request and during the time that mediates between the entry of the request and the creditor’s response, payment of the fees may not be required.

TYPES OF CREDITS AND BENEFICIARIES

The types of credits that are included in the project are those of consumption, including those with collateral and credits automotive, for up to 3,000 UF; mortgage for the acquisition of the property that serves as the principal residence of the debtor, for an amount of up to 5,000 UF; lease to acquire personal property of up to 3,000 UF or real estate for up to 5,000 UF and cash advances with credit cards for no more than 10 UF.

The initiative establishes that those who prove that they are within the 70% lowest income in the Social Household Registry will be eligible for the benefit; beneficiaries of the Emergency Family Income; those who are receiving or have availed themselves of Unemployment Insurance; independent workers who report a significant decrease in their income; debtors of credits to access education provided by Corfo, as well as micro, small and medium-sized companies whose annual income from sales, services and other activities does not exceed 75 thousand UF.
