This Thursday begins the process to make the second withdrawal of 10% of the AFPs effective, which is why the Minister of Justice and Human Rights, Hernán Larraín, reiterated that insurers have a maximum period of 10 business days to pay alimony owed.

The foregoing, after a series of indications of the portfolio chaired by the Secretary of State were approved, during the processing of the project in Congress, which established the mechanism for withholding the funds of those people who have unpaid debts with their sons and daughters.

In this way, the law requires that the judicial resolution ordering the retention, indicate the specific amount that must be paid and identify the bank account where the amounts must be deposited.

Likewise, – and as noted – a maximum period of 10 business days was established for the AFPs to transfer the money to food and the deadlines for notification of court decisions to the AFPs were shortened, allowing the use of electronic means for these purposes.

Finally, the new law indicates that when there are two or more withholding orders, and the obligor does not have the sufficient sum, a proportional amount may be obtained that allow the payment of both pensions.

Along these lines, Minister Larraín explained through a statement that “we have detected the presence of problems in the payment of maintenance debts during the first 10% withdrawal, therefore, for this second withdrawal, we resolved those problems by through indications that correct three big three points ”.

“First,” said the owner, “we solved the difficulties that existed in notifying withholdings to the obligors; second, we define a formula to solve what to do when you have more than one unpaid pension; and third, we decree that the AFPs, as soon as the court orders it, have a maximum period of 10 working days to transfer resources to food ”.
