Comedy legend Carol Burnett is seeking custody of her granddaughter, Dylan, over her daughter Erin Hamilton’s ongoing battle with drugs.
“Because of addiction problems and other circumstances that my daughter Erin has difficulty influencing her immediate family dynamics, my husband has [Brian Miller] and I have filed a petition in court to be appointed legal guardian of my 14-year-old grandson, ‘Burnett, 87, told Page Six in a statement on Thursday.
“Guardianship will be for oversight purposes regarding his health, education and well-being and is not intended to deny him or her parents a good visit with each other,” the statement continues. “We look forward to recovery that is the next step for normalization and are currently asking for privacy to prevent that process.”
The court documents – obtained by The Blast – note that Burnett and Miller are only seeking temporary detention.
“Throughout her adult life, and since Dylan’s birth, Erin has suffered from severe substance abuse and addiction problems,” the custody reads, according to the site. “Over the past 19 years, Erin has been in and out of rehab centers and has been institutionalized a total of eight times for a minimum of 30 days each day.”
“Dylan’s living environment has long been unstable, unpredictable and unhealthy for a child. This culminated in a Department of Child and Family Services (DCFS) investigation and procedures for juvenile dependence in 2018 and 2019, ”reads the submission, according to The Blast.
The submission reveals a host of details about the battle of 52-year-old Erin. In July, Hamilton was placed on an involuntary 5150 psychiatric seizure following a suicide attempt; Burnett contacted the LAPD for a wellness check. Dylan’s father, Kurt West, recently checked in on the rehabilitation himself, the submission also appears, and the Children and Family Services department is investigating the family in 2018 and 2019.
Hamilton, Burnett’s youngest daughter, is a singer who has recorded multiple hits on the American dance charts, including two number one in 2008. Dylan, born in 2006, is the youngest of her two children; her parent, Zach, was born in 1997.
Burnett’s eldest daughter, Carrie, also dealt with substance abuse before becoming sober for her 18th birthday. (Burnett’s third daughter is Jody, 53.) “When we got [Carrie] in a third rehabilitation, oh, she hates my gut, ”Burnett told AARP magazine. “You have to love them enough to make them hate you.” Carrie died in 2002 at 38 from complications of cancer.
In 2019, the Hollywood Foreign Press Association established a Golden Globe Award in the name of Burnett for career achievements in television. Steve Carell presented the inaugural statuette to Burnett.
