In connection with publications in the media about the poor condition of the water supply network in the country, incl. for the construction of aqueducts with pipes not adapted for the supply of water, thus creating the preconditions for both accidents and water spills, at the initiative of VAP in February 2020. An inspection has been assigned to the president of the Energy and Water Regulatory Commission (EWRC).
The object of the inspection is the content of the programs to reach the annual target levels of the quality indicators of the drinking water and sewerage services provided, including the reduction of water losses in the approved business plans; actual implementation of the activities of the repair programs and production of the business plans, mandatory for the water supply and sewerage operator; use (when carrying out the last activities) of materials that correspond in quality, purpose, etc. and they are acquired by the water and sewerage operator for their investment in the reported works.
In the results presented by the EWRC it is concluded that from the inspection carried out on the implementation of the approved business plans, none of the water supply and sewerage operators has established the full implementation of all quality indicators in 2019, in accordance with the levels approved in the business plan. Of a total of 29 companies with an approved business plan, 5 reported more than 50% non-compliance, 11 reported between 40 and 50% non-compliance, and the remaining 13 companies did not achieve quality levels that ranged between 7 and 11.
The number of negative findings listed in the EWRC report. This imposed additional measures within the framework of the legal supervision procedure, in protection of the public interest and based on Art. 145, paragraph 1, subsection 6 of the Judicial Power Law (ASJ) of May 2020. The President of the EWRC is hired by VAP for evaluation to take action under article 38 of the Law on Regulation of Water Supply and Sewerage Services, in view of the administrative responsibility for non-compliance with the quality indicators of the supply services of water and sewerage by the respective operators.
The same VAP law also specifies standards of the Ordinance for the regulation of the quality of water supply and sewerage services and the Ordinance for the regulation of the prices of water supply and sewerage services, which it assigns to EWRC to evaluate the quality of the water supply and sewerage services provided based on the individual annual target levels achieved for the quality indicators of these services. This assessment is reinforced by the regulations with the possibility of applying financial corrections, which imply a change in the approved prices of water supply and sewerage, by changing the coefficients of the income required of the operator under the Ordinance on price regulation water and sewerage services. period 2017-2021
