Due to the greater interest of the public and the media and after the permission of the supervising prosecutors under art. 198 of the Criminal Procedure Code, the Sofia City Prosecutor’s Office provides the following information: During the pre-trial procedure, the technical expertise of the photos and videos published in the media was designated and prepared, which were allegedly taken in the apartment used by the Prime Minister of the Republic of Bulgaria, Boyko Borisov.

According to the expert’s opinion, two of the photos show that the objects on the bedside table are arranged in a very similar way, although the photos themselves, according to the data extracted from the archives, must have been taken in an extremely long period of time – almost a year and a half. Regarding the video, it was found that in the time interval from 21 to 22 seconds the reflection of the cameraman was briefly seen – a woman in a black dress, sleeveless, with a bracelet on her arm, with dark hair, but bad quality, and being a reflection, it is difficult for the expert to determine more details.
To establish the identity of the person, possible evidence from the video was collected, but so far the same has not been established. The conclusions of the experts indicate that the analyzed files are not the originals, so it is impossible to draw definitive conclusions based on the data from them, what and when they were taken. Despite an objective, exhaustive and complete investigation, it is not possible to establish on what dates the photographs were taken, if the banknotes seen in the open drawer were genuine, what their total face value and quantity were, and whether the rectangular objects yellow in the drawers are gold, or whose property is.
Based on these circumstances, the supervising prosecutors do not find that there is evidence in the case of a crime related to the nature of the items in the photos and video, the origin of these items, or the regime of their possession, which requires separation. of materials under the PPC. This is because, regardless of the crime under the Penal Code that is being investigated, the main question to answer is whether the material evidence in the case reflects objective reality. In the established factual situation, after taking all the possible actions of the investigation at the time, no definitive evidence has been collected in this regard.
SGP draws attention to one of the possible hypotheses in the case, in view of its obligation to notify the competent prosecutor’s office in case of data on the composition of another crime, different from the object of investigation in the investigation phase. This refers to the assumption made by the witnesses in the case that the attached video and photos reflect a specially arranged interior with elements, in order to present a certain negative image of the Prime Minister of the Republic of Bulgaria, Boyko Borissov.

In this regard, it should be clarified whether there are omissions and violations in the performance of official functions of the relevant employees of the NSO, related to the effective provision of personal security of the Prime Minister of the Republic of Bulgaria and the external security of housing. Therefore, the supervising prosecutors have separated the pertinent materials, which have been sent under the jurisdiction of the Military District Prosecutor’s Office. After taking all possible actions in the investigation, the team of prosecutors considers that there are reasons to suspend the criminal process for not revealing the perpetrator of the crime.
