The Constitutional Court unanimously terminated the case at the request of President Rumen Radev to establish the unconstitutionality of the decision of the National Assembly, which established a special commission to consider the draft new Constitution of the GERB.
The reason is that last week the deputies ended the activity of the commission, after, as expected, the parliament did not gather a sufficient majority (160 votes) to convene a Grand National Assembly (SJC) to approve a new one. basic law. .
The new commission, headed by Desislava Atanasova from GERB, held only one meeting. It was boycotted by the opposition and the BSP and MRF did not nominate their representatives.
However, prior to these events, the Constitutional Court requested and received opinions from prominent constitutionalists, according to which an ordinary National Assembly can only decide whether to have a Supreme National Assembly, but not amend a submitted draft of a new constitution. They are Prof. Ekaterina Mihailova, Prof. Pencho Penev, Prof. Plamen Kirov, Prof. Snezhana Nacheva, Prof. Yanaki Stoilov, Associate Prof. Atanas Slavov, Associate Prof. Natalia Kiselova and Associate Prof. Hristo Paunov.
One of them, Slavov, told Bulgarian National Radio this morning that he hopes the constitutional judges will not just stop.
“I assume, however, that with the reasons given by the Constitutional Court, there will be very clear instructions and instructions for future majorities that intend to abuse a constitutional procedure, even if the operative part is to terminate the process,” he said.
However, in its ruling, the Constitutional Court only mentions that the legal opinions received support the presidential motives. And since it was specified that the commission was no longer functioning, the case was closed and the application was returned to Rumen Radev.
