New attack by the National Revenue Agency on Miglena Kakanasheva – Megz. This time the tax authorities beat the company “Megz 36”. Rakovski’s designer received an act in the amount of BGN 3,000 due to the lack of tax structure and, respectively, the non-issuance of cash receipts. The company serves Megz’s online boutique and the attack follows Kakanasheva’s request to register the company for VAT purposes.
According to the ordinance of the Ministry of Finance, commercial companies engaged in the activity are required to operate and use cash registers registered with the National Revenue Agency, specifies “Trafficnews”.
However, this did not happen in 2019, when it was the first sale related to the designer’s activities. On April 15 of last year was the first shipment of clothing to customers. However, they did not receive a receipt for the merchandise from the company, as it was delivered by courier. Precisely because of the lack of a receipt, the NRA employees “killed” an act of Megz.
However, the criminal decree was referred to the jurisdiction of the court. In her complaint, Kakanasheva described the sanction as illegal. She also claimed costs related to the case.
In fact, the company’s punishment was unfounded. The reason: in the criminal decree the way in which the goods were paid was not entered. This is an important circumstance, as it can be judged by whether it was necessary to provide a receipt. According to the Ordinance, the company is not required to issue a receipt and have a fiscal when the payment is made by cash deposit in a payment account, bank transfer, direct debit or cash transfer. In this case, the tax authorities did not describe how the goods were paid for.
Again, for the same reasons, Rakovski’s designer got rid of an act. Then another of his companies, Megz 9, was attacked. Kakanasheva had again applied for the company’s VAT registration and it was again established that her boutique did not have a fiscal device in place.
