According to the current constitution, the consideration of the draft of a new basic law of the GERB will last between 2 and 5 months. This was explained to Nova TV by the former constitutional judge Prof. Plamen Kirov.
Regarding the possibility of an impeachment procedure for the head of state, Professor Kirov explained that for this procedure to reach the constitutional court, at least 2/3 of the votes of the deputies are needed.
“Even if there is an impeachment, somebody thinks there will be a new presidential election. If someone from the GERB likes Vice President Iliana Yotova more as president within the term he has left, let him try,” said Professor Kirov.
“The preliminary draft of a new GERB Constitution provides at least 2 months for the National Assembly and the government to act with relative comfort, if what is happening around these buildings is comfortable as a situation,” commented the professor.
He explained that from September 2 to November 2, the project presented will not be considered, because it is stipulated in Chapter 9 of the current Constitution.
“The examination of the draft must begin on November 2. This examination can last 3 months. The Constitution establishes a period of no less than 2 months and no more than 5 months in which the draft constitution submitted must be considered.” Professor Kirov explained.
According to him, so far the MRF has proven to be a systemic party, and once they have said they will not vote to convene a Grand National Assembly, they will most likely not back down.
“That is, support for the draft decision to convene the Supreme National Assembly on the basis of the procedure initiated in Chapter 9, this is an almost impossible mission,” said Professor Kirov.
“The goal is for the government not to resign so that there can be regular elections in March next year. There are legal techniques that could do so. The second major goal of the GERB is to avoid a provisional government appointed by the President,” said Professor Kirov.
