The leader of “Will” can go to prison,
leave parliament on parole
sentence or be acquitted in the case of
the extortion of businessman Asen Milanov
There are four options for the development of the case against Veselin Mareshki before the last instance – the Supreme Court of Cassation, showed a “24-hour” inspection.
The first is that his 4-year prison sentence is upheld, and then the vice president of parliament will go behind bars.
The second is that the Supreme Court of Cassation change its sentence by reducing or conditioning it. In this case, if he remains a deputy, Mareshki will have to leave his elected position, because by law he has no right to hold it.
The third: the Supreme Court of Cassation to annul Mareshki’s sentence and acquit him.
Option 4 is for the Supreme Court of Cassation to refer the case back to the Varna Court of Appeal, where it will be heard by another panel.
Such options also faced former Interior Minister Tsvetan Tsvetanov in 2015, when the Sofia Court of Appeal sentenced him to four years in prison for 6 “No” for requesting the use of special intelligence against the former head of the BOP in Veliko Tarnovo. Orlin Todorov.
The Supreme Court of Cassation as a third instance then returned the case to the consideration of another panel of the Court of Appeal, where it was acquitted, and then the Supreme Court of Cassation confirmed the acquittal. Therefore, completely innocent, Tsvetan Tsvetanov remained a deputy.
On Monday, the Varna Court of Appeal announced that the leader of Volia and Vice President Veselin Mareshki had been sentenced to four years in prison for
extorted for 10
thousand BGN per month
businessman Asen Milanov from Varna. The businesswoman Krassimira Koleva will remain behind bars for 3 years and will pay a fine of BGN 6,000. In the first instance, both were acquitted.
The crime was committed in the fall of 2014. According to the indictment, Mareshki and Krassimira Koleva, convicted with him, blackmailed Milanov, owner of the pizzeria. The man paid the restaurant rent to Toni Dimitrov, Koleva’s ex-husband. He wanted to receive the money with the help of Mareshki as he was unable to regain ownership of the site in court. Milanov refused to pay Koleva and this caused a conflict between the parties. Several complaints were filed against the tenant. An external structure was demolished and the restaurant’s electricity was cut off.
In the course of the case it became clear that
due to a loan of
BGN 65,000
It was established
mortgage
between wife
by Mareshki
and Koleva,
According to the prosecution, this obligation is the reason for the intervention of the MP in the case.
However, Mareshki claims that he sold part of Koleva’s property some time ago, and Asen Nikolov settled in the rest, which was not his, for which he was convicted in three cases.
The leader of “Will” insisted that the rest of the property was his property, but so far he had not done what it took to prove it. According to him, Milanov illegally expanded his restaurant.
Krassimira claimed to have received the rent for the property on Studentska Street in Varna, which the owner of the Red Hot Asen Milanov pizzeria paid to her ex-husband Toni Dimitrov.
According to the indictment in the case, Mareshki intervened in this plot after Koleva asked him for help with the idea of paying off his BGN 65,000 loan to a local businessman and politician through future rental income. The prosecution also claims that this obligation on Koleva was the reason for Mareshki’s actions, which were aimed at “breaking the will and motivating the victim Asen Milanov to start paying extortion.”
The case before the court of appeal was initiated on the basis of a protest by the prosecution and an appeal by Asen Milanov, requesting the revocation of the acquittal issued by the District Court. The court panel found it necessary to clarify the property relationships between the two defendants, as alleged in the protest. The two defendants declined to comment. During the trial, a witness close to Milanov was questioned, who said that due to the loan of BGN 65,000, a contractual mortgage had been established between Koleva and Mareshki’s wife in his capacity as manager of a company. This was confirmed by a reference in the Registration Agency.
In 2017, the President of the Trial Chamber recused himself and the case was reassigned to another rapporteur. A decision was then submitted to the Central Election Commission that Mareshki was
chosen for
national
representative and
you already have immunity
This forced the case to be sent to the Sofia Municipal Court and it was suspended. Then Chief Prosecutor Sotir Tsatsarov asked lawmakers to lift the immunity of Mareshki and other lawmakers under investigation. The leader of “Will” gave his protection by law. Later, the Supreme Court of Cassation returned the case against him to Varna. The court panel was removed and a new one was elected.
Mareshki’s lawyers, Milen Ralchev and Ina Lulcheva, insisted that he had not committed any crime. According to them, she had no motive because Krassimira had no property obligation to her. In fact, the debt is with Mareshki’s wife and rather with her company. According to Milen Ralchev, he helped her without any material interest.
On October 18, 2018, the Varna District Court acquitted Mareshki and Koleva in the first instance. According to the prosecution’s investigation, Milanov’s extortion was accompanied by destruction and damage to property and caused significant damage of BGN 14,838.
According to the trial court, Mareshki and Koleva did not commit any crime.
Veselin Mareshki was initially charged with inflicting minor bodily harm on Vazrazhdane leader Kostadin Kostadinov, a friend of Asen Milanov, during a scandal on October 15, 2014, and with trying to protect him. However, the accusation was dismissed on prescription.
Mareshki will not flee the country and will defend himself in the third instance, he said in a video message following the decision of the Varna Court of Appeal.
“The first verdict in the first instance that I am innocent, as well as the one that I am guilty, are intermediate units. The important thing is what the third instance will say. It is clear to most impartial viewers that I am innocent. The moment was chosen very well so that in a few days the report to Brussels can show that there is a convicted politician in Bulgaria, although not in the first instance, and that the judiciary is independent, “said Mareshki.
“I will be the only Bulgarian if the Supreme Court confirms the sentence, that he will be sentenced for asking to rent his property. I will explain: there are two properties on the site, one is part of the restaurant that my family business sold to Krassimira Koleva, so I know very well what is mine and what is not. The tenant of the property has absolutely illegally expanded into mine and it should be clear. The goal is to tarnish my name, ”said the leader of“ Will ”.
