On Friday news from the Brussels-based Euroactive BG website, run by left-wing editor Georgi Gotev, sensationally announced that 7 of the 10 names had been personally “rejected” by Laura Coveschi. Euroactive BG referred to the Chief of Staff of the European Attorney General Milan Jaron, who gave credibility to the information.

However, Free Europe was the first to notice that hours later the name of this senior European official had disappeared from the publication. Such development has given a signal that it may be an attempt to sabotage the Bulgarian magistrates who will work with Laura Coveschi. This important detail was confirmed to Free Europe by the Ministry of Justice and the spokesperson for the SJC Prosecutor’s Office, Kalina Chapkanova.

And this is not an extraordinary event, but it is part of a procedure that is at a stage in which rejection is impossible, nor is it the responsibility of Laura Coveschi, but of the College of European Prosecutors, whose office is in Luxembourg. It includes a total of 22 prosecutors appointed by their country of origin. Teodora Georgieva is the European prosecutor for Bulgaria.

Already on November 16, 2020, this college established rules to carry out a selection procedure for European delegated prosecutors. According to art. 1, point 2 of the document, the European Chief Prosecutor can ask the Member State for additional information on the respective candidates, as can Koveshi.

According to art. 3 of this decision, not only she, but also a working group of European prosecutors, appointed by the college, can assess whether the nominated candidates meet the requirements for the position.

According to the rules, Koveshi will make its evaluation only after it has gathered all the information on the proposals, even if additional information has been requested. But it is not she, but the College of European Prosecutors, who decides whether a candidate meets the criteria or should be rejected.

According to the rules of the 22 European prosecutors, if there is a refusal to appoint, this must be very well argued, indicating what requirements the candidate does not meet.

According to unofficial information from the SJC, even before the start of the selection procedure for our representatives, the EPPO sent detailed information on the requirements to hold the post. It explicitly stated that European prosecutors could be both prosecutors and judges and investigators.

By regulation, each country was supposed to nominate at least two prosecutors, but a year ago Laura Coveschi asked for more candidates many times and this led to the 10 delegated prosecutors from Bulgaria. This also explains why the proposals include investigators who, although they have not appeared in court, have experience in complex investigations of financial crimes.

Coveschi herself has lobbied member states for greater commitment and support, even increasing the number of delegated European prosecutors. This also means a significant increase in budgetary costs for the operation of the institution, which cannot happen without a consensus between the parties. According to official statements, Bulgaria has always supported the EPPO.

And Koveshi herself promised that the new structure would first deal with almost 3,000 cases since 2017 related to crimes from the European budget.
