A few days ago it became clear that part of the Sozopol fortress wall will be demolished. The demolition was imposed following a decision of the Burgas District Court and concerns a restored fortress wall. The reason is that 6.5 square meters of the wall, which is part of the Architectural and Historical Complex “Wall and Tower of the South Fortress” in the old town of Sozopol, enters a private property.
Expert examination of the case indicates that there are no visible traces of an ancient architectural monument, that the fortress wall is newly built and does not represent a reconstruction of the foundations of a wall from Antiquity or the Middle Ages.
The wall in question has been restored for more than 15 years, but in 2014 it became clear that it was illegal in some part. “The project for the removal of part of the fortress wall was drawn up by the Sozopol City Council and since the old town of Sozopol is an architectural reserve, it was submitted to NINKN in June 2020 and has awaited approval since then”, said the Municipality of Sozopol in its official position.

– Mr. Pinelov, how do you explain that the court’s decision on the wall has not yet been implemented?
– I want to clarify that the court in 2014 ruled that the wall was erected illegally. The Order № DK-10-YUIR-13 of 24.04.2013 of the Head of RDNSK and the construction permit №34 / 02.03.2011 were revoked by the Administrative Court of Burgas in the part / scope of LPR XXIII-224, quarter 18 according to the plan of the city of Sozopol, since the decision is final and entered into force on May 14, 2014. I make this clarification to make it clear to everyone that the case could and should have been resolved 6 years ago by the then administration municipal under the direction of Mr. Panayot Reyzi.
It is then that this case arises with the clear awareness that the law is being violated. Six years ago, the municipality became aware of the court’s decision and, for whatever reason, did not take steps to implement it in a way that would satisfy the court, the property owner and the public interest in the now famous fortress wall. This clearly shows the attitude of the then government towards the law, the rights of the people and the development of the city as a whole.
– Were you able to meet with the current mayor and talk about the case?
– I am familiar with this case at the beginning of the new period. Even last year’s budget included an amount that had to remove that part of the wall that is the subject of the court decision. Even then we talked to Mayor Yanakiev about this. The new administration took action and a project was prepared for the removal of part of the fortress wall, since the old town of Sozopol is an architectural reserve. The project was submitted for approval to NINKN in June 2020 and has been pending approval ever since. In this year’s budget, we again set aside funds for the implementation of this project and we are still awaiting the decision from NINKN.
Mayor Tihomir Yanakiev shares my opinion that the court’s decision should be implemented, but so as not to drastically violate the general vision of the stone wall already erected. The court ruled on the basis of art. Of the case. In conversation with the mayor, he said that he will appeal the decision before the Burgas District Court in the part for the amount to which the municipality was sentenced.
– After the demolition, could the wall be moved outside the private land, how could the walk be fixed after pushing the wall?
– In my opinion, the wall in this part cannot be moved to the sea, outside of private property, because the alley is too narrow. It involves removing 6.5 square meters of stones that have been additionally placed. That is why a special project was carried out to guarantee the right of the property owner and at the same time preserve the general vision of the wall, which by design was to follow the contours of a medieval fortress wall. But this can happen only after NINKN has ruled on the project and agreed to its implementation.

– The alley itself is very busy in the summer. How will a demolition affect the comfort of tourists in the next season?
– The project has been maturing in NINKN for a year, and it would be good to do it before the summer season. I am sure that the removal of the illegal part of the wall and the implementation of the project will be done so as not to affect the tourists walking through the alley. It could be done on the property with the permission of the owner, as built, although later the masonry on his property was done without his permission and against his will.
– What is the basis of the case in your opinion? Why is this wall problematic?
– Over the years there have been other troublesome cases related to the alley and the wall of the newly built fortress. For example, the construction of a hotel in this part of the city also outraged the local community years ago. There are other houses along the fortress wall, but they were not demolished to build a wall in their place. They are socialized with her. This was the way to proceed with the part we are talking about right now.
Why it wasn’t done, I have no idea. I also don’t know why someone rudely and unceremoniously enters private property and starts laying stones. I can only assume that the people who did it felt untouchable and unpunished. Personally, I admire the court’s decision, because it corrects an injustice. And the wall, as one of Sozopol’s new tourist sites, will remain and will continue to attract the interest and imagination of Sozopol guests.
