“I still believe that the proposal made in this way continues to contradict the Constitution. There is no such procedure to declare any kind of emergency, as a result of which the fundamental rights and freedoms of citizens will be affected,” Sharkova said. He noted that even now, in the Health Law, there is a possibility that the line minister will introduce measures against the epidemic in certain situations. According to her, it was possible to list specific detailed measures, the prerequisites for their impact and grant the relevant powers to the Minister.

The pandemic requires swift action, but this does not relieve us of the obligation to be good legislators and not create legal absurdities.
