Chief Prosecutor Ivan Geshev offers life in prison for causing death in an accident if the driver had a high concentration of alcohol in the blood or after using drugs. This was announced by chief prosecutor Siika Mileva’s spokesperson in a briefing, BNT reported.

The proposed change in the Penal Code, which addressed the executive and the legislature, is that drivers who killed on the road after using drugs or alcohol for more than 2 per thousand should be punished with prison for 15 to 20 years or life sentence. and confiscation of the vehicle involved in the accident.

Intentionally causing death in an accident in the absence of a driver’s license or exceeding the speed limit by more than 50 km / h is also punishable by up to 20 years or life imprisonment.

The Attorney General also wants to confiscate the car, regardless of who owns it, while driving with more than 1.2 per thousand alcohol or after using drugs. Under the law, the vehicles owned by the author of the accident are now being confiscated in favor of the state.

Ivan Geshev sent his proposals in a letter to the Prime Minister, the President of the National Assembly and the presidents of all parliamentary committees.

Current punishments do not always correspond to public expectations and do not guarantee justice for victims or victims’ families, said Siika Mileva, cited by BTA. He reported that the number of investigations is growing and if in 2015 there were 90 cases, in 2019 there are already 3 thousand. An analysis of the state prosecution showed that the use of alcohol or drugs, driving without a license and speeding are the main causes of the large number of accidents.

Ivan Geshev has given instructions in the case of intentional transport crimes to request the seizure of the vehicle. A working group has also been created to analyze the jurisprudence of the practice of transportation, and the Supreme Court of Cassation will be called for an interpretative decision.

In late April, shortly after the accident that killed TV presenter Milen Tsvetkov and the 22-year-old driver who hit his car, tested positive for drugs, authorities suggested more severe penalties for such cases. The proposals for changes in the Penal Code presented by GERB foresee that the penalties for causing death during a road trip increase with prison from 3 to 8 years, and in particularly serious cases, from 4 to 12 years. Currently, penalties are 2 to 6 years and 3 to 10 years in prison, respectively.
