The European Court of Human Rights in Strasbourg was sued over a statement by Chief Prosecutor Ivan Geshev on Roma, after several Bulgarian courts and the Commission for Protection against Discrimination acquitted him of his remarks, the website defacto.bg reported. . It is about Geshev’s interview with BNT in April 2019, in which he commented on the Ivancheva case and said: “We expected Petko Dyulgerov (accused of being a helper) to resign, and the Gypsies do.” Dyulgerov announced that our first statements to investigators had been received under pressure.
Ivan Geshev’s words prompted Polish activist Xpisto Hikalov to refer to the Commission for Protection against Discrimination. However, it indicated that the case was in a general context and that the right of civil opinion was being exercised.
Following this decision, Nikolov filed a defamation lawsuit with the Sofia Region Administrative Court, which concluded that the statement was “unifying and unifying” and did not represent “separate and / or separate” parties. The decision of the two previous institutions was also confirmed by the Supreme Administrative Court, which even pointed out that Ivan Geshev could not be prosecuted for discrimination at all, because he is in charge of his finances.
Now the appeal against the ECHR is the violation by the state of art. 8 of the Human Rights Convention, which affects the right to respect for private life. According to the Civil Code practice, the right to respect for private life encompasses the individual’s social identity and the inadmissibility of the “family oven”.
The complaint also alleges that art. 13 of the Convention (right to effective remedies) and art. 14 (prohibition of discrimination). Hikalov’s interests before the European Union are represented by lawyer Alexander Kashumov.
The appeal before the Court of Cassation cites the proceedings before the CPD and the administrative courts.
