The deputies of the Legal Commission rejected the president’s veto of the texts of the Law of the Judiciary, adopted on September 3, reported a reporter from Novini.bg. The amendments were approved again by 15 votes to 7.

At the beginning of the meeting, Rumen Radev’s adviser took the floorRumen Radev

Rumen Georgiev Radev is a Bulgarian military reserve major general. Former commander of on legal issues – Emilia Drumeva. She explained the reasons for the veto.

“The president’s veto is not opposition, but an opportunity for discussion,” said Drumeva.

It became clear that the head of state is opposed to the systematic offer of the highest political body of the country, the National Assembly, of “career bonuses” for the members of the Supreme Council of the Judiciary (CSJ), which as a constitutional body is called upon to guarantee the independence of the judiciary. power.

The reasons for the president’s veto also establish that when the law creates preconditions for certain individuals to be appointed to higher judicial bodies on the basis of criteria other than objective, there is a risk that political considerations will prevail. and hence the risk to the independence of the magistrates. In this sense, the new version of art. 28 of the ASJ contradicts the principle of separation of powers (article 8 of the Constitution) and the principle of independence of the judiciary (article 117, paragraph 2 of the Constitution).

The president’s veto of the so-called legal commission members will discuss a “career bonus” for the SJC

During discussions in the legal commission, the president’s team pointed out that there is a constitutional case № 10/2020 for declaring the provision of § unconstitutional. 4 of the Amendments to the JSA for the amendment of the provision of Art. 28, para. 1 of the JSA (SG promulgated, number 64 of 07.08.2007, last modification and complementation – SG, number 11 of February 7, 2020) in its part, which provides for the expiration of the mandate of an SJC member or in case of his early termination, the latter will be reinstated … “or a degree higher than the position he held before the election in the Judiciary.”

The BSP stayed behind the veto.

However, the MRF objected that the view that these were “professional bonuses” was incorrect and did not agree with the president’s motives.

“In view of the elaborate selection criteria, the SJC assesses whether this magistrate meets the conditions for the position. In this sense, we cannot avoid challenging the arguments to interfere with the judiciary and violate the principle of separation of powers.” Hamid Hamid said.

GERB did not comment on the president’s veto.

Meanwhile, the members of the Legal Commission must also approve the rules of procedure on the terms and conditions for the nomination of candidates for president of the Central Electoral Commission.
