The defense advisor to the head of state, Iliya Milushev, was illegally arrested during a prosecution operation in the presidency in July. This was ruled by the Sofia District Court, before which the 24-hour arrest warrant was appealed, DeFacto reported.
Milushev was arrested on July 9 after prosecutors and Witness Bureau officials stormed the presidency to search and confiscate evidence. Later, Chief Prosecutor Ivan Geshev boasted that his actions had not been approved by one, but by two different judges: the specialized court and the military court.
The presidential campaign was one of the catalysts for the massive anti-government protests during the summer. The other main reason was the public discontent that erupted after the action of the co-president of “Democratic Bulgaria” Hristo Ivanov in Ahmed Dogan’s summer barn in Rosenets.
After his arrest, Milushev was charged with inciting an official crime. Investigators allege that he incited a former intelligence officer to hand over secret documents to harm the intelligence chief.
Milushev’s arrest is illegal: it was carried out by the police on the verbal order of a prosecutor, according to the court decision. There was no evidence that the presidential adviser was involved in the crime attributed to him. Furthermore, before his arrest he was interrogated in connection with the same investigation and always appeared.
“According to the order, not only the legal basis must be taken into account, but also the final factual circumstances. It is not final and can be appealed.
The saga with Milushev is only one part of all fiscal activity throughout the presidency. During the same operation, the Presidential Secretary for Legal Affairs and former Interior Minister, Plamen Uzunov, was arrested. Subsequently, the prosecution announced that it had a close relationship with businessman Plamen Bobokov and passed on secret information to him. Bobokov’s phone chats have been posted for weeks.
