Vaklin Hamchev, sentenced by the District Court to 5 years and 4 months in prison for causing the death of three youths through negligence in an accident, appeared before the Court of Appeal today. The case began as a result of a protest by the prosecution and a complaint from the defendant and the victims’ families, a reporter said. Plovdiv24.bg.
Before the court hearing, the families of the deceased Filip Mihailov, Mihail Mihailov and Angel Zmiycharov attacked the driver Khamchev, cursing him for contracting an incurable disease.
We remind you that 46-year-old truck driver Vaklin Hamchev, who mistook a detour on the Pazardzhik highway, backed up and hit the BMW with the three boys with the trailer. After the collision, the three young men died at 22, 23 and 32 years old. The accused was punished 7 times for various infractions on the road.
“The appeal of the prosecutor is because the court has defined the crime as a not particularly serious case. I believe that the sentence of 5 years and 4 months is inappropriate. Three young people died in their prime,” said the prosecutor during the trial .
What are the previous violations on the Hamchev road and the maneuver that he carried out on 05/13/2019, are not commented on in the court’s grounds. We must increase the sentence and return the case to court for a new trial, “said lawyer Sariiski, who represents the families of the victims.
The other representative of the private prosecutors, lawyer Chatalbashev, asked the Court of Appeals to increase the penalty to 18 years in prison, considering that the violation had been committed intentionally.
“The incident was committed at a crossing, the prosecutor did not describe that there is a 60 km / h limit, and the young people drove at least a little, but at excessive speed and if it were not like that, there would be no accident. This circumstance should wanting to change it and reduce the sentence, “said attorney Paskalev, Vaklin’s attorney. He noted that his client was not a systemic offender, did not allow other accidents, and did not use alcohol or drugs prior to the incident.
“I’m sorry for what happened, my life has taken a 180 degree turn. Let my sentence be what decides,” Hamchev told the court.
The appellate magistrates will decide what will be the fate of the accused within a month.
