According to the Code of Civil Procedure, enforcement can only be directed at pensions with a monthly amount higher than the minimum wage, that is, deductions cannot be made from lower pensions.
Thus, in practice, more than 85% of pensioners in Bulgaria have protection against seizure, according to data from the National Social Security Institute (NSSI). It involves more than 1.8 million Bulgarians who receive a pension of up to BGN 650.
The application cannot be imposed on workers who receive up to the minimum wage.
Most of the time, pension seizure is required due to unpaid heating. People whose pensions and salaries have already been seized under art. 446 of the Code of Civil Procedure, starting next year there will be a change in the amount of the deduction, as a consequence of the new amount of the minimum wage for the country.
If a pensioner or employee receives between BGN 650 per month (which will be the minimum wage) and BGN 1300 (double its amount), a third of the income will be deducted if they have no children and a quarter if they have any. . Therefore, if the salary or pension is BGN 651, the seizure will be BGN 195 or BGN 162.75 per month, respectively, depending on whether there are children.
If the convicted person receives a monthly salary of between BGN 1,300 and 2,600, it will be divided between half or a third of the amount, respectively, if they do not have children. Pensioners with higher pensions will fall here, as from January 1, 2021 the maximum pension will rise to 1,440 BGN.
