The Sofia City Prosecutor’s Office suspended the criminal proceedings over the photos and video of Prime Minister Boyko Borissov’s bedroom because it could not establish who the “beautiful lady” “Mata Hari” (as Borisov himself called her) was. The images were made public after audio recordings, photos and videos were sent anonymously to the media in June and July and were repeatedly commented on by Borissov himself.
His first explanation was that it was compromising information – some time ago a GERB executive committee was meeting at the residence – it is possible that someone directed the photos. Later, however, the prime minister released a new version: President Rumen Radev sent “a beautiful lady to photograph him”, and then made it clear in his own words that he himself knew who the lady who took the photos was and the video.
However, the prosecutor’s office did not say whether Borisov himself had been questioned at all, or whether it had been established which women had visited him at his residence and whether they had been questioned. From the description of what was done, it can be concluded that the Prime Minister was not the subject of an investigation in this case and the question of which bundles of 500 euro banknotes and gold bars remains unanswered.

Thus, in practice, after several months of investigation, the State Prosecutor’s Office officially put an end to one of the biggest political scandals of the year, after just a few days ago it ruled in a similar way and announced that it would not initiate pre-trial proceedings. by audio recordings.
Today the prosecution recalls that on July 29 they filed a complaint in media publications and began a process prior to the trial for the crime of using, without the proper authorization of the law, a special technical device for the secret collection of information (according to article 339a , paragraph 1 of the Penal Code). code).
Technical expertise has been appointed and prepared on photographs and videos published in the media, which were allegedly taken in the apartment used by Prime Minister Boyko Borissov.
The photos were taken in 2017 and 2019.
It is understood from experience that files have additional easily noticeable changes in weather characteristics and their names. Some of them have changed the filming dates: 2013, 2021, 2024, while the dates extracted through the experience of the archives are September 25, 2017, January 4, 2019 and February 6, 2019 .
This information, by the way, has already been established by the private expert opinion ordered by two editions: “Bivol” and “E-newspaper”. He pointed out, in addition to the specific dates, the time of the shooting and it is easy to detect who was the visitor to the residence of the prime minister, recorded in the security newspapers.
One of the photos is reduced in size, according to the prosecution. According to the expert’s opinion, two of the photos show that the objects on the bedside table are arranged very similarly, although the photos themselves, according to data extracted from the archives, must have been taken in an extremely long period of time – close a year and a half.

For the video, it was found that at the time of 21 to 22 seconds, the photographer’s reflection is briefly visible: a woman in a sleeveless black dress, with a bracelet on her arm, with dark hair.
Due to the poor quality, as well as the fact that it is a reflection, it is difficult for the expert to determine more details, said the Prosecutor’s Office and assured that all possible evidence was collected in order to establish the identity of the woman from the video. . there are currently no results.
However, if Borisov himself is not asked who the woman is and if all her visitors have not been located in recent years, there is obviously no talk of gathering “all possible evidence.”
At the same time, in an interview with FAZ, Borisov performed a specific scenario: “Take a look at this purse – there is enough room inside to collect small gold bars and wads of money. The prosecution did not mention in its conclusion whether it had clarified the case, nor did it explain what prevented the prime minister from remembering where and when he gave the interview he was talking about.

The conclusions of the experts indicate that the analyzed files are not the originals, so it is impossible to draw definitive conclusions based on the data from them, what and when they were taken.
“Despite an objective, exhaustive and complete investigation, it is not possible to establish on what dates the photographs were taken, if the banknotes that were seen in the open drawer were genuine, what was their total amount and face value, and if the objects Yellow rectangles in the drawers are made of gold, nor who owns them, ”said the prosecution.

Therefore, the investigating team has accepted that there is no evidence of crime related to the nature of the items in the photos and video, the origin of these items or the regime of their possession, which would require the separation of materials under the PPC. .
Regardless of the crime of the Penal Code that is being investigated, the main question to answer is whether the physical evidence of the case reflects the objective reality. In the established factual situation, after taking all the possible actions of the investigation at the time, no definitive evidence has been collected in this regard, according to the Prosecutor’s Office.
The prosecution draws attention to one of the possible hypotheses in the case: the assumption that the witnesses in the case say that the video and photos “reflect an interior specially arranged with things to present a certain negative image of the Prime Minister of Bulgaria, Boyko Borisov “. .

According to the Prosecutor’s Office, “this hypothesis goes hand in hand with other evidence established during the investigation.” From the technical experience prepared, it can be assumed that the video recording and filming were done by persons other than the employees of the National Security Service (NSS). Therefore, according to the state prosecutor’s office, it should be clarified whether there are omissions and violations in the performance of the official duties of the relevant employees of the NSO, related to the effective provision of personal protection of the Prime Minister and the external security of the home in which you live. For this reason, some of the materials were separated and sent under the jurisdiction of the Military District Prosecutor’s Office. As soon as the scandal broke out, in June 2020, by order of the head of the NSO, an official inspection was ordered.
