A speeding driver on the Trakia highway not only failed to pay a fine of BGN 1,050, but also ordered the Traffic Police to cover the expenses of his lawyer. This happened after the driver contested the electronic ticket that was issued to him in the Plovdiv District Court.
On August 19, the man was driving his Mitsubishi on the highway from Sofia to Burgas. A patrol with a camera was stopped in the Plovdiv area, which took it at a speed of 239 km / h.
Initially, he was issued a ticket for BGN 850, on which it is written that he was photographed at kilometer 108 of the highway. However, the slip was canceled. It is written new, but with the same number. It has already been said that he was filmed at 107,600 km on the Trakia motorway at 235 km / h and was fined 1,050 BGN.
The dzhigit attacked the slip in court as illegal and unfounded. He claims that it did not contain a description of the rape and the place where it was committed. The driver explained that the construction of his car did not allow him to develop such speed.
The magistrates accepted the complaint as well founded and canceled the fine. Their main argument is that the issuance of a new voucher seriously violates the rights of the applicant.
“Two electronic receipts have been issued for the same person. Although their simultaneous existence is not allowed, the administrative-criminal body has exceeded its powers,” the sentence reads.
The other reason for the fine was that the camera position was wrong by 300 meters.
“The place where the rape took place remains controversial,” the court said. According to him, these inaccuracies make the landslide illegal.
The Regional Directorate of the Ministry of the Interior in Plovdiv will have to pay BGN 600 to the offending driver, the same as it spent on his lawyer’s fees.
“There are many cases where electronic safeguards are canceled. The most common reason is non-compliance with the procedure by the traffic police. They have to draw up a report where the violation occurred and often this document is not applied Errors are also made in the very description of the illegal driver behavior, sometimes there are no mandatory details in the documentation, ”commented the Plovdiv district court.
The magistrates point out that the cancellation of an electronic form and the issuance of another is inadmissible.
“It’s like reading a sentence, reversing it and issuing a new one, because the punishment of the previous one seemed small to you,” said a Plovdiv magistrate.
Police declined to comment on the ruling.
