The parking stands in front of the blocks are illegal. This was ruled by a panel of the Supreme Administrative Court in a final decision on the case. The case was presented 3 years ago by the former mayor of Plovdiv and current deputy Slavcho Atanasov, he recalled. Plovdiv24.bg. This is what Atanasov said:
“Friends, I have good news. We have won the case against the municipal ordinance on parking supports. The Supreme Administrative Court of last instance has ruled that this part of the parking ordinance should be withdrawn. The decision is final and unappealable. The municipality was unfair, incorrect, legally untenable, discriminatory and, above all, it generated great tension among the people of Plovdiv and generated neighborhood conflicts. I am glad that justice triumphs facing the final decision of the SAC!
Based on the foregoing and for reasons of art. 222 par. 2 point 1, the Supreme Administrative Court, composition of the eighth division,
YOU HAVE DECIDED THE FOLLOWING:
CANCELED decision № 248 of 30.01.2020 under Adm. № 3643/2019 of the Administrative Court – Plovdiv and, instead, DECIDES
CANCELED art. 8a of § 2 of the Ordinance to amend and supplement the Ordinance on the terms and conditions for the issuance of a permit for the use of municipal property in the territory of the municipality of Plovdiv.
The decision is final. “
The three-member SAC panel ordered the Municipal Council – Plovdiv to pay the costs of the case, incurred by the plaintiffs – S. Atanasov BGN 80, E. Vassilev – BGN 980, D. Petrov – BGN 1,580 and Juvenis EOOD, UIC 202083993: the amount of BGN 2320.
