The FIFA World Cup accepts the current club CSKA-Sofia as the successor to the old club, which was declared bankrupt and therefore the “reds” will have to pay old debts with former players. This follows from a decision related to a complaint by Nilson Antonio, according to which CSKA will have to pay a fairly solid amount to the player. A similar decision was made for Bernardro Tengarina.

The decision related to Nilson Antonio was made on August 9 of this year, and according to information from dsport has already been appealed by CSKA in CAS, as it could cause a serious financial blow to the club.
According to him, CSKA owes the player a total of 286,001 euros and must also pay court costs of 2,000 Swiss francs. A fine of 20,000 Swiss francs was also imposed, which must be paid to FIFA.
The World Cup has given a 30-day period to pay the debt, otherwise CSKA should have been prohibited from presenting players until the debts are settled. However, the appeal to CAS stopped this sanction for the time being.
The motives of both parties in the dispute are more interesting.
CSKA asserts that they have no legal, financial and organizational connection with the original debtor PFC CSKA AD and the new club PFC CSKA-SOFIA. In particular, the new club is stated to be the legal successor to Litex and offers the following explanation: “In the 2015/2016 season, Litex Lovech Club was eliminated from the Bulgarian First League. At the beginning of the 2016/2017 season , a group of entrepreneurs bought the company PFC Litex Lovech AD and the legal entity behind the club Litex Lovech. The main idea of these entrepreneurs was to create a club that maintains and reflects the historical sports history of the former club, which at that time was already bankrupt and did not develop organized football. Therefore, on June 2, 2016, the entrepreneurs considered the company name PFC Litex Lovech AD to be PFC CSKA-Sofia EAD. The new club participates in the newly created First League of Bulgaria (2016/2017 season) with the sports license of the Litex Lovech club.

At the same time, however, FIFA ruled that the new club PFC CSKA-Sofia EAD should be regarded as the debtor’s sporting successor. The disciplinary commission considers that the bankruptcy of the original debtor does not automatically release his sports successor PFC CSKA-Sofia from the obligation to comply with a decision of the CAS of 2015, which must pay the debts with former players.

Furthermore, the names of the two clubs are similar, and according to the official website of the new club they share the same history and sporting achievements, ”FIFA said in a statement.
Currently, the dispute over the debts with Nilsson Antonio and Bernardo Tengarina has already been appealed to CAS, but if the Lausanne court finally accepts the decision of the FIFA Disciplinary Committee as valid, it will be a serious financial blow for CSKA. Thus, in addition to the obligations to the two footballers, it is possible that other former players join the club with economic claims, and there will already be a precedent on which to step.
