The owners of tobacco warehouses in Old Plovdiv are obliged to strengthen them, according to an order from the mayor of Plovdiv. This is the final decision of a three-member panel of the Supreme Administrative Court. Confirms the decision of the Administrative Court – Plovdiv.
The case in the Supreme Administrative Court was initiated following a complaint against an order of the mayor, by which the owners “RIPA” Ltd. is obliged to carry out fortification works on buildings damaged by fire.
The Supreme Magistrates accept that the buildings represent architectural and construction cultural value and are both an individual cultural monument and part of a group architectural and construction cultural monument in Old Plovdiv.
According to the provisions of the Cultural Heritage Law, the protection regime is mandatory for all individuals and companies.
The facts established in the case give rise to the right of the municipality to issue an order that obliges the owners of the building on their own to carry out the necessary conservation, restoration and repair works within a specified period, the judges are inflexible.
The mayor’s order is legal and the complaint filed against him is unfounded and unproven, the SAC decision reads.
