Biden will deliver the Obamacare speech as the Supreme Court weighs in on the future of the law


Biden’s transition team scheduled an ET speech at 2pm on the Affordable Care Act in Wilmington, Delaware.

Supreme Court judges are hearing oral arguments in a case where the speech comes on the same day that the landmark health reform law seeks to be invalidated. They will likely take a preliminary vote at their private Friday conference on Friday and begin the process of writing opinions, although a decision is not expected in the first half of 2021.

The administration of President Donald Trump is considering undoing the signature health law of former President Barack Obama. And even though Biden will take office on January 20, he can do very little: even if his administration turns parties and argues in favor of Obamacare, the case will continue because the original lawsuit was brought by a coalition of Republican attorney generals.
Defending Obamacare was a central theme of Biden’s campaign. During the Democratic primary, he argued for the expansion of the law by adding a “public option” to allow Americans to buy into government-run health insurance plans and through federal premium subsidies that would make coverage of the Affordable Care Act more affordable. He opposed the push to abandon completely private insurance in favor of a single-pair, “Medicare for all” type system of more progressive rivals.

The Trump administration and the Republican-led House and Senate failed to repeal Obamacare during Trump’s first two years in Congress. Trump and the GOPA enacted a tax law in late 2017 that gutted Obamacare’s personal order by imposing penalties on insurance 0 for not having insurance.

The Trump administration later joined the Republican-led states, which argued in court that the individual order became unconstitutional with congressional action, and that it is part of the Affordable Care Act, so the entire law should be repealed.

Tuesday’s speech comes as Biden’s transition becomes more controversial, with Trump refusing to admit and making a series of baseless claims trying to undermine the legitimacy of the election. His administration has not yet taken legal action to allow Biden’s team to enter the transition process for .. 3 million, as well as giving access to federal agencies.
