Under the current status, the special care period should only be available for three weeks as an accompanying measure to the closure until February, without any legal rights. That is, the employer had to give its approval until now. The state had paid up to a third of the costs to the employer in the spring, now it should be 50 percent in the fall.
With the new regulation that has been agreed, there is a legal right to a special attention time with retroactive effect from November 1: the consent of the employer is no longer required. Instead of three, the special care period can now be used for four weeks and also applies to quarantined children. Effective immediately, the federal government will take care of the full reimbursement, that is, the employer will be reimbursed 100 percent of the compensation costs. This new regulation applies until the end of the 2020/21 school year.
Family Minister Christine Aschbacher (VP) described it as a “concern of the heart” to strengthen the compatibility of work and family even in times of crisis. “That is why I have made sure that families do not face multiple burdens again.” With the legal claim and the extension, the federal government secured this and also relieved the company with full reimbursement of costs.
Vice Chancellor Werner Kogler (Green) emphasized that the crown pandemic and the tasks associated with it represent a particular challenge, especially for women. The work of caring for children and family members to take care of falls on them to a much greater extent. “So it was important to us Greens that there was a legal right to special care hours,” Kogler explained. “It is an indispensable help and relief for the women and families of Austria.”
