Vienna (OTS) – As the news magazine “profil” reports in its current issue, there are sensitive issues in relation to a 3.3 million euro delivery contract from the Ministry of Health for antigen corona tests. The offer for 1.5 million pieces went to a tender consortium formed by the pharmaceutical company of a Lower Austrian pharmacist and a GmbH, albeit named but not specified, on February 25, 2021 at the request of Bundesbeschendung GmbH (BBG ).
Said GmbH appears, with slightly different spellings, in Germany and played a central role in an indictment by the Düsseldorf public prosecutor. This was reported by the magazine “Der Spiegel” in early 2018. It was the accusation of defrauding companies and merchants with official letters, which were later followed by aggressive collection efforts.
It is said that the two brothers from the outskirts of Cologne, who still own the GmbH, from what can be seen from the business register, were significantly involved in it. The accusation was finally rejected in early 2020 by decision of the Higher Regional Court (OLG) of Düsseldorf. However, this was done on the basis of legal considerations. In response to a profile request, an OLG spokesperson said: “The defendant’s alleged conduct does not correspond to normal business conduct in the context of fair competition and should be socially and ethically disapproved, but it does not yet constitute a crime of intent. of fraud “.
The BBG, for which the GmbH is officially identified as a supplier within the tender consortium, refused to provide specific information on the profile request and did not even confirm that it was the German company. The Lower Austrian pharmacist also did not want to comment on this, nor on the question of whether he had other partners in dealing with the Ministry of Health.
