Private police checks: chronology of a political collapse

  • The Ministry of Health

Under the Epidemic Law, the police can now support the health authorities. Apparently, they wanted to expand the specific powers; who exactly wanted that is unclear, it was not announced. Ministry officials then formulated a new sentence for paragraph 28a, paragraph 1a, allowing entry to the premises.

The only question is: what rooms? A group of lawyers advising the ministry, in principle, were not concerned that the police would also search private homes, but if you wish, you must specify the powers, according to comments at the end of last week.

Later, the officials specified in the explanations that the “other buildings” mentioned in the new law include “private living spaces.”

This is, he continues, “absolutely necessary when the fulfillment of the separation notices (quarantine, note) is verified or when an orderly evacuation is verified”.

The draft hit the Greens internally. KURIER was shown an email conversation on December 4, in which some voiced their concerns about regulation: the private area is taboo for the Greens. There are also green members of the government in the address bar.

  • The ÖVP clubs and the Greens

This week, the draft became an amendment signed by representatives of the ÖVP and Green clubs. The green side sent him to the SPÖ, FPÖ and Neos clubs on Wednesday night.

In the email it was indicated that the request related to mandatory registration (see below); police checkpoints are not mentioned. The SPÖ noticed the passage and raised the alarm on Thursday. FPÖ and Neos agreed and spoke of a “police state” that the ruling parties apparently wanted to introduce in secret.

Green Health spokesman Ralph Schallmeiner explained on Friday when asked by KURIER that it was not an intention, but a “nasty mistake”: “The explanations passage was unfortunately overlooked by everyone involved.”
