President of VfGH: Freedom of movement is a basic condition of autonomy

President of the Constitutional Court (VfGH) Christoph Grabenwarter shows some understanding that the laws and regulations in the crown crisis were so poorly designed that they had to be repealed by the highest court. In the Ö1 series “Im Journal zu Gast” he spoke of a special situation the government was in, also because the Minister of Health was only briefly in office. In view of the dimensions of the crisis, Grabenwarter does not appear to have waived the usual evaluation procedures. There were good reasons for it. But despite the pressure of time, it does not rule out structural deficiencies as a cause and demands that the ministries do not save on specialized personnel.

The president of the Constitutional Court also made it clear that there could be drastic legal interventions again. However, the formulations would have to be appropriate. The VfGH has lifted the drastic exit restriction, it could return if the legal basis is created, said the VfGH president. “But we have emphasized that this right to move freely is a basic condition of the autonomy of the individual,” he continues. That is a key message that cannot be stressed enough.

Consider an earlier statement by Chancellor Sebastian Kurz (ÖVP), who spoke of legal niceties in relation to legal doubts about Corona’s measures, quite sparingly. This was a statement where he thought: “A politician was under pressure.” He probably wouldn’t know her like that today. (red, off)
