The police will be with a “massive force in the demonstrations”. However, from the point of view of the Vienna State Police Directorate, it would make sense for the health authorities to ban these meetings in advance for epidemiological reasons. This would give legal certainty to the police when it comes to intervening and could “stop a risk to the health and safety of all those involved through a tactical intervention.”
Pürstl considers a legal theoretical discussion in relation to assemblies to be “secondary” today.
The city still sees responsibility with the police
The Vienna City Council, in turn, has asked the Ministry of Health in a letter to eliminate the passage from the ordinance, which states that the health authority must be consulted (KURIER reported).
The city demands that the police be solely responsible. After all, you cannot say in advance if the measures will be followed and only the police are on the scene. The Ministry of Health now wants to invite all parties to a clarifying discussion.
Constitutional lawyer Peter Bußjäger told KURIER that the police could have intervened anyway, even without consulting the authorities. In the country it is easier, because there the district authorities are the health and assembly authorities.
