Due to gross negligence of an underage person resulting in death – Non-legally binding convictions.
For gross negligence of an underage person resulting in death, a 40-year-old man and his wife (36) were sentenced to five years in prison on Tuesday at the Krems Regional Court. It is said that they received no treatment for their 13-year-old daughter’s chronic pancreatitis. According to the autopsy, the disease had caused the death of the girl. The two sentences are not final.
The defendant appeared Tuesday for the second time in the case on trial. The sentences of February 12, also five years in prison each, had been overturned by the Supreme Court, necessitating a second judicial process. One of the reasons was that the offense cited in the sentence at that time was too broad. However, the jury’s verdict was upheld by the Supreme Court, which dropped the original charge of murder by omission.
