The mayor of Linz, Klaus Luger (SPÖ), cannot understand that the traffic light in Linz has been changed to yellow by the Crown Commission. Already on Friday morning he said at a press conference: “We will not adjust the traffic light because of this dark construction of the traffic light.” The traffic light is “arbitrary”, the exit is a “botched”. He partially disabled this view Friday night in a conversation on ZiB2. As soon as there is a legal basis, you will adhere to it. It is simply “incomprehensible in fact”. Luger is particularly concerned that it is stigmatized as a risk zone. According to him, the uncertainty among the people is great.
In the interview he made it clear that as long as there are no corresponding laws for such orders from the federal government, he will not take any action. For the moment, he considers the yellow status and the hardening it entails, “without legal basis”, simply as a “recommendation” from the Minister of Health. If a legal basis emerges next week, it will implement it.
Those discussions about the implementation of the Corona traffic light measures broke out during the day. Therefore, the Constitutional Service had made it clear on Friday afternoon that the regulations must also be observed by municipalities and states. The statement literally says: “Ordinarily announced regulations must be applied and followed by all people. In statutory cities, the mayor also acts as a district administrative authority and is bound by instructions to the responsible federal minister (for health) within the framework of indirect federal administration through the respective governor, ”writes the APA.
Currently, the government lacks the legal basis for the traffic light, but at least one wants to enforce the extended mask requirement, for example, in all commerce, through a regulation. The regulation for the extended mask requirement, which has been tightened due to yellowing in Graz, Linz, Vienna and the Kufstein district, should be published no later than next Friday.
The corresponding amendment to the two laws can only be decided by parliament at the next meeting of the National Council on September 23 and then enter into force on October 1 at the earliest.
