He is said to have stabbed his 48-year-old partner in December 2019 at the shared house in the Mistelbach district with a kitchen knife with a blade length of about 15 centimeters. The guilty verdict against the Vienna-born stateless person is not final.
The bloody act of December 8, 2019 marked the end of a long-term relationship. In the weeks and months before, the couple, who had been in a relationship since 2005, had repeatedly raised disputes. Furthermore, because the 48-year-old woman had met another man over the Internet in the fall, according to the prosecutor, she drew a line under the association with the defendant about a week before his death. They both still lived in the same house.
On the afternoon of December 8, the 48-year-old was not at home, the defendant spent time consuming alcohol and herbal cannabis. He had “drunk some beers, whiskey and vodka” and also smoked “six to seven joints,” said the stateless man with twelve relevant criminal records.
When the woman returned home, she found out for the first time about her partner’s new friend, the defendant emphasized. The 54-year-old no longer knew how long it had been since then until the first of a total of six stab wounds against the victim. According to his own account, the man took the weapon from a knife block in the kitchen during the dispute. He couldn’t remember how often and why he stabbed. “You have no explanation for this?” Asked the presiding judge. “No, I would,” replied the defendant. “She was the woman of my life.”
The central theme of the main audience was the 54-year-old man’s alcoholism at the time of the crime. Defense attorney Manfred Arbacher-Stöger spoke of “a movie tear” from his client and took on a seizure while intoxicated. In this case, the sentence would have been up to three years in accordance with article 287 of the Penal Code. A chemical report confirmed that the accused was between 2.35 and 2.6 per thousand in the period of the possible crime from 6:00 pm to 8:00 pm In view of these values, the psychiatrist Peter Hofmann did not assume a total intoxication.
The jury judged the facts and the alcohol levels as did the expert and unanimously affirmed the main question about the murder. “It is an absolutely reprehensible act of relationship,” said the presiding judge, who also spoke of an attack carried out with “such brutality.” The 54-year-old man’s numerous prior convictions, among other things, had an aggravating effect on the assessment of the sentence, while the man’s lower guilt was assessed as mitigating. Defense lawyer Arbacher-Stöger immediately filed a complaint for annulment and an appeal, the prosecutor waived an appeal.
