In the run-up to the vote on the new Corona law, the FPÖ filed a motion of no confidence in the federal government. Thanks to the SPÖ’s approval, Health Minister Rudolf Anschober was able to order various measures starting next week.

The FPÖ club president waited with cordial words Herbert Kickl to start the parliamentary debate on the Crown law. The coalition had launched its “parliamentary list orders”, had traced a “trail of devastation” through the country and had endangered “our prosperity.” From a liberal point of view, Austria should be oriented on the Swedish route. “I don’t know what you have against the Swedes. In Greta, everyone chased a Swede ”. The excitement for Corona is artificial. “The government is trying to ‘kill a fly with a hammer.” Kickl also launched strong attacks against the SPÖ, allowing the coalition in the Federal Council to pass resolutions quickly. The SPÖ betrayed the interests of the unemployed. “I don’t know the Judas salary they received. ”For this, the FPÖ club president received a call to order.

SPÖ grants Turquoise-Green a majority in the Federal Council

In the afternoon, the National Council becomes the controversial Amendments to the Epidemic and Covid Law decide the health ministers Rudolf anschober (The Greens) should give an expanded arsenal in the fight against the corona virus. The Federal Council will approve the amendment, and the day after the Federal President signs the new regulations and the Chancellor announces them, they will be ready for use.

In theory, individual presenters or governors could re-prescribe a minimum distance between people in public space or even impose exit restrictions next week. This is possible because the SPÖ decided, after a long evaluation process, to support the proposals. The opposition does not have a majority in the National Council, but in the Bundesrat the SPÖ and FPÖ (they vehemently reject the new law) could have reversed it and delayed it for several weeks.

Live from 9 am, Corona debate from 12 pm:

Member of the SPÖ-Vice-Club Jörg Leichtfried It records as a success that Anschober changed numerous points of the law during the appraisal: “We got a new law introduced and we got this new law appraised as well,” Leichtfried said. Among other things, it insists that the main committee of the National Council must be involved in imposing restrictions on a large scale, and that it is limited in time.

“The development was characterized and is characterized by a great struggle responsible for a good balance between basic rights and health protection,” Anschober says of the success. The rest of the opposition is not convinced: the Neos are particularly critical of the fact that the government can unilaterally extend the law, which must apply until the middle of next year, until the end of 2021; the FPÖ already imagines itself as the crown of fascism and expresses its distrust of the entire government.

The new rules at a glance:

1. Curfews and entry bans: As is well known, the spring departure restrictions (“there are only three reasons …”) had no legal basis. It should now be delivered later. In coordination with the main committee of the National Council – which is involved was a first concession from the government – Anschober could then order that entry and driving or permanence in certain places be prohibited or restricted. In any case, the private housing area is always excluded, the five exceptional cases of emergency, assistance, coverage of basic needs (purchases), work and recreational opportunities are stipulated.

2. Return of the baby elephant: Anchober does not have to completely prohibit entry to all public places, or certain places (such as individual stores), but it may also be subject to conditions. For example, keeping a certain distance.

3. Traffic light on right: The Corona traffic light and the commission that changes them have a legal basis, until now they have only operated as an informal body. In the future, the Minister of Health will have to listen to them before decreeing measures under the Covid Law.

4. Objectification: Because the Constitutional Court has required that all pandemic measures must be based on factual arguments, the law now establishes which criteria should be used to assess the epidemiological situation: cluster analysis, hospital occupancy, the proportion of positives in all tests and regionals. Special features such as tourism and traveler flows.

5. Responsibilities: Austrian health authorities are linked together in Byzantine chains of command according to complex indirect federal administration. A new “cascading regulation” now aims to clarify liability in the event of an epidemic. Going forward, the minister of health, state governors, and district authorities will need to issue ordinances at the national level.

6. The courts are exonerated: Until now, each quarantine has to be reported to the responsible district court (you should only check after a three-month period anyway). In the future, they should only be those that last longer than ten days, that is, no longer the vast majority of corona quarantines.

7. Schul-Screenings: The education minister (currently Heinz Faßmann, ÖVP) should in future order corona detection programs in schools and commission school doctors or laboratories to implement them. This is to prevent school clusters.

8. Sanctions and controls: Police officers and other bodies of the security service may stop in the future to verify compliance with the requirements. Violations can result in fines of up to 1,450 euros or 30,000 euros for entrepreneurs who fail to comply with the requirements. Private housing areas are explicitly excluded from the controls. A rule that gave authorities broad search rights recently caused a stir: it will be cleaned up in the final version of the law.

9. Events with “bigger crowds” They also get slightly modified rules: these must be approved subject to certain conditions or prohibited. Among other things, organizers must present a “prevention concept” to minimize the risk of infection. An obligation for catering companies to create guest lists that had to be completed voluntarily, which was foreseen in a previous draft, was dropped.
