Corruption investigations in the Constitutional Court (VfGH): Former Minister of Justice and current constitutional judge Wolfgang Brandstetter (ÖVP) is suspected of having transmitted information on ongoing criminal proceedings. That would be an abuse of power. The prosecution was able to secure an “electronic device”, as was the case with the Chief of the Justice Section, Christian Pilnacek.
AUSTRIA. The prosecutor’s suspicion: in both cases there would be a suspicion of violation of official secrecy in relation to the Heumarkt skyscraper and the investor Michael Tojner. Brandstetter has denied speculation that it would have provided information to Tojner multiple times. According to his lawyer, the “electronic device” was not handed over to the VfGH but to his office. According to “Kurier”, a notebook from former Justice Minister Brandstetter and the cell phone of Section Chief Pilnacek were obtained. In the latter case, the Ministry is considering a suspension.
VfGH is not part of the judiciary
According to the Constitutional Court, investigations against a constitutional judge are not grounds for consequences: “Objectively, there is nothing against Brandstetter. You can be quick to be the accused. And it should not depend on the criminal justice system whether a judge is able to act or not: the VfGH is a court of law, but it is not actually part of the judiciary, ”the VfGH said in a written statement to ZiB2. As for the investigations against Pilnacek, confirmed by the Vienna Public Ministry, the facts are known and will be examined internally, according to the evening newspaper Ö1 of the Ministry of Justice. Pilnacek declined to comment. According to media reports, there is a suspension in the room.
“Obviously ruined again”
The ÖVP again criticized the Economic and Corruption Prosecutor’s Office (WKStA): “Obviously, the WKStA has been wrong again,” said Justice spokeswoman Michaela Steinacker, alluding to the procedures of Finance Minister Gernot Blümel (ÖVP) . Corruption investigators suspect abuse of power and bribery in connection with donations and zoning in the case of Christoph Chorherr, former city councilor and planning spokesman for the Vienna Green Party, and charitable donations for his school project in South Africa. Heumarkt’s investor, Tojner, is among the defendants, and all are presumed innocent.
