Former Salzburg mayor Heinz Schaden (SPÖ) will now receive a political pension after his final conviction in the exchange case.

This is possible thanks to an amendment to the Salzburg Payments Act, according to which part of the pension remains despite the sentence. On Monday, the city Senate approved the notice of gross pension for damages in the amount of 1,408.84 euros.

“Lex Raus” is the term used in the internal circles of the Mirabell Palace to describe the change in the law: because the former state finance official and LHStv also suffered damage. Othmar Raus (SPÖ) was eventually convicted. After nearly three decades in state politics, including 23 years in state government, he would have lost his entire political pension. The amendment to the Payments Law, which was announced in March of this year and will be applied retrospectively from October 1, 2019, now states that, unlike public officials, the politicians’ pension will not be completely eliminated It will be reduced to the amount in question Period as an ASVG pension would have arisen.

In addition also the ASVG pension

Schaden was a member of the city government from 1992 to 2017, as mayor since 1999, and during this period paid the Polit-Pension. After his resignation, he was awarded a gross pension of 5,851.64 euros, which, however, was eliminated after the sentence entered into force on October 2, 2019. The decision on the now political pension of around 1,400 euros is served, and then you have the opportunity to appeal against it. In addition, Schaden also receives an ASVG pension.

The exchange process dealt with a minor aspect of the Salzburg financial scandal that unfolded in December 2012. In 2007, the city transferred six negative interest rate swaps to the State of Salzburg, without any consideration in return. As a result, the country suffered damage of at least three million euros, according to the court. The accusation was infidelity. The damage received three years in prison, one of which was essential. They got two and a half years in prison, of which ten months absolutely. Damage currently affects an ankle bracelet, due to permanent inability to go out you do not have to go to prison or an ankle bracelet.
