Numerous attorneys have seriously questioned the rule of law of many restrictions imposed by regulation or law in the wake of the Corona crisis. Health Minister Rudi Anschober (Greens) has commissioned a group of lawyers to investigate the allegations, including Clemens Jabloner. The former justice minister also criticized federal chancellor Sebastian Kurz (vice president) on Friday. He cannot speak like this “before the Constitutional Court so that it can correct everything later”.
- Video: Since the start of the coronavirus pandemic, 144 articles of law have been amended or republished. Numerous constitutional and legal experts now criticize the procedures.
For Jabloner, the Chancellor’s Office would have had the same duty to review the laws as Karoline Edtstadler (VP), constitutional minister. Edtstadler’s counterattack: Due to the urgency, all parties would have agreed to shorten the legislative process. This does not provide for control by the constitutional service. Responsibility for regulating exit restrictions rests exclusively with Anschober.
Interior Minister Karl Nehammer (VP) also generated a lot of dust with the plan to use the executive in “contact tracking” by the health authority “as a kind of flex (an angle grinder, note).” Specifically, criminal police officers should question those infected with a crown to locate their contact persons.
Nehammer’s request, however, is rejected even by his compatriot and party friend, Johanna Mikl-Leitner. In his country, people trust the efforts of the 250 employees of the health authority because the vast majority of those affected are already very cooperative, the governor of Lower Austria wrote. Comment from FP club president Herbert Kickl: “The infected are not criminals”, there is no need for “interrogation specialists”.
