The defendant’s lawyer, who had always protested his innocence, immediately filed an appeal for annulment and an appeal.

Friends before the incident

The 16-year-old and the defendant were friends before the incident. According to prosecutor Julius Heidinger, the groom had consumed some alcohol at his bachelorette party, but was still sane. There is no objective evidence that the young man had suffered a significant psychological deterioration before the crime, explained the expert.

Increased penalty range

Prosecutor Heidinger later modified the accusation: since the young woman’s psychological problems had to be considered a serious injury, the range of sentences increased from 10 to 15 years. Hans Gradischnig, the 30-year-old’s defense attorney, said it was “highly doubtful” that a violation had actually been committed and that his client should be acquitted in case of doubt.

However, the jury had no doubts about the guilt of the 30-year-old. Judge Kugi highlighted the credible information provided by the 16-year-old, who described the event realistically. She confronted the 30-year-old with her accusations the next day, which he did not deny at all. In determining the sentence, the man’s innocence was taken into account: “On the other hand, it is particularly reprehensible for someone to rape a 16-year-old girl at her own bachelorette party,” Kugi said.

Prosecutor Heidinger did not comment. The judgment is not final.
