On April 18, he picked up his new girlfriend in the afternoon and introduced her to her parents. He then wanted to introduce her to his friends, which is why the young couple went to a private party. They drank too much, so no one could drive anymore, he said looking back. Still, she got in the car in the early hours of the next day to drive her girlfriend and best friend home. “I turned the ignition key,” the next thing she remembers is her head hitting the airbag, she said.
Traveling at 125 km / h
What had happened in the intervening minutes, the judge reconstructed on the basis of expert opinions. The girl in the passenger seat did not survive the impact, and neither did the 20-year-old. The expert’s conclusion: if the driver had kept to 100 km / h as prescribed, the car would not have hit the tree. The young man, who was in the hospital for three days, was traveling at 125 km / h.
“Don’t drink another drop”
When the judge asked him why he was driving drunk, according to the blood test, it was 0.96 per thousand, he said he probably still felt fit to drive. But the excessive consumption of alcohol in the defendant not only leads to a “self-evaluation”. He’s also getting aggressive, he admitted. Therefore, in Steyr, the personal injury charge was also negotiated by the Linz prosecutor. On December 25, 2019, he had an argument with two girls in front of a nightclub, after which he hit.

However, he stressed that the four-month prison was absolutely necessary in addition to the twelve months to “dissuade everyone from getting behind the wheel while intoxicated.” It also recognized the benefit for pain to the parents (15,000 euros per parent) and siblings (8,000 euros) of the deceased. The defendant was also instructed to continue his therapy and to see a doctor for a blood test every three months. The prosecution and defense did not appeal.
