“Now he’s going to be black,” thought the young policeman before the heavy impact came. The police car collided with a Jaguar from the favorites distribution group. The vehicles skidded to one side and struck a woman. The 35-year-old Ukrainian, a German teacher, was killed on the spot.
“Fateful” is what attorney Alfred Boran calls it. It depicts the young policeman who was leading the patrol on August 29, 2019. The officer was 21 at the time. “Not a day goes by that I don’t think about the victim.”
The young man must answer in the district court of Vienna-Favoriten for negligent homicide and negligent bodily injury (two colleagues in the car and the Jaguar driver were also injured, note).
“Not guilty,” says the policeman.
The prosecutor sees it differently. He sees various misconduct that ultimately should have led to the fatal accident. So he entered the distribution circle in red. Without following the tone of the horn. And without stopping when entering. Even if you put it in perspective: “Very few emergency vehicles stop your vehicle in such cases. However, the protection rule has been violated.”
On the way to a fight
It was around 4 p.m. when the police were called into a fight. The three, an aspirant sitting in the back seat, pushed their way. “There was a lot of traffic,” recalls the accused police officer. Describes the mission as “moderately urgent.” He activated the blue light and hit the next horn tone, but not the continuous loop. “If I press once, the signal repeats twice,” he explains.
Finally, the red light on the distribution circuit. The following horn tone was pressed: Two vehicles had blocked the road. When they cleared the way, you stopped at the stop line, protests the policeman. “So I activated the next horn tone again.” Cars in two lanes stopped, no cars were recognizable in the third lane. A fatal mistake.
When the police stopped, a black Jaguar collided with his car. “I only saw him out of the corner of my eye at the last moment,” says the policeman. And the Jaguar driver describes: “Suddenly a car was in front of me and the next moment it crashed.”
“Someone is lying there!”
Cars were thrown sideways. “That’s when I realized I had just had an accident with a police car,” says the Jaguar driver. When he got out, he saw the pedestrian lying next to the police car. The policeman remembers: “My colleague came out. Suddenly he yelled: Someone is lying there!”
The young man had only completed his basic training with the police for two months. “How many trips was that?” Asks a lawyer. “I can’t tell you that. He’s pretty fast on favorites.”
A total of three trading dates are planned. The verdict will be issued on October 14.
