Those affected would have violated the ban on contact because they would continue to live in the same (!) Home with their Corona-positive partners.
Those affected are now falling from all the clouds for various reasons. They have lived together for years in their main residence and were apparently not even searched for rapes. In addition, it is likely that authorities have learned of the life partners of the corona positives on contact tracing. And last but not least, the sanctions are apparently issued for a time when partners have not even tested positive for the coronavirus.
The man tests positive, the woman must pay
As the ORF further reports, a lawyer now stands by the person in question without paying a fee, because he considers the punishments to be illegal. One of those affected told him and the ORF that he tested himself for the corona virus and obtained a positive result. He claimed that he lived with his partner in the same home, so the woman was called.
She also claimed that she was living with the man and therefore saw him for the last time on the day of the exam. Result: since the man tested positive, it is said that the woman violated the contact ban and now pays 300 euros or goes to jail. However, the couple was never searched and the lawyers assume that the punishment is inadmissible. Also because the couple had no choice but to live in their apartment.
There are no alternative rooms possible
He should not have gone to family or friends due to his partner’s corona positive test, the hotels and lodgings were closed. In the country, however, the fact that those affected would describe their life situation themselves using contact tracing is erased and, therefore, they would activate the sanctions.
Lawyers see that differently too, because lying is prohibited in contact tracing and if personal information was also used for criminal court orders instead of contact tracing, this could be unconstitutional, or it could lead to people being vetted. just no longer provide contact persons.
