Anderl: “Palm scans are not necessary for payroll accounting!”
Vienna (OTS) – The AK has filed a complaint against Plachutta with the data protection commission because employees have to sign their working hours records with a palm scan. AK President Renate Anderl says: “Palm scans are not required for payroll accounting! Whats Next? Do you have to sign your employment contract in blood soon? “
Plachutta employees must sign a consent form with their employment contract for the palm print to be scanned, which is saved with their signature. Once a month, employees are instructed to check their working time records – they see a list of their working hours on a tablet and must confirm it with a palm scan. The employee automatically signs the list.
Working time records are only shown very briefly to employees on the tablet for viewing and confirmation. It was and is not possible for employees to compare the records with their own and thus control them. Renate Anderl, President of AK: “We want the employer to deliver the records in writing without the employer having to request it, and for the employees to have enough time to verify them. There has to be so much time, which is a requirement of fairness to the employees. “
The AK sees multiple data protection violations here:
1. The collection of highly sensitive biometric data, such as palm printing, is completely excessive for payroll accounting purposes. One signature is sufficient, as is the legal requirement and is also practiced in all other companies.
2. The declaration of consent necessary to record such a sensitive date would have to be voluntary. However, there are two reasons why voluntariness does not occur here: on the one hand, because the conclusion of the employment contract is linked to it and, on the other hand, because the balance of power between employer and employee is not balanced here .
3. Employees were not informed that they can withdraw their consent at any time.
4. You have not been informed about your right to information.
5. Upon termination of employment, the palm scan would be removed within 14 days. That sensitive date should be removed immediately.
Renate Anderl, AK President: “This approach should not set a precedent. The Vienna Chamber of Labor will use all labor and data protection instruments to protect the rights of employees. “
