For three women it was the heart’s desire to have a child. One did not survive the necessary procedure, two others fell into a life-threatening coma. Due to a fatal treatment error at the fertility clinic in Baden (Lower Austria), an experienced anesthetist had to respond to two cases in the Wiener Neustadt regional court on Wednesday for grossly negligent manslaughter and grossly negligent bodily injury. In the event of a guilty verdict, the doctor faces up to five years in prison.
According to the indictment, the anesthetist with more than 30 years of professional experience made a fatal mistake.
“I can’t believe them”
The beginning of the process today was only a brief interlude. Because the single judge, who was supposed to direct the process, issued a ruling without jurisdiction. According to the sole judge, the defendant must be charged with fatal bodily injury before an unprofessional judge. The decision is not final.
“I can’t believe the claim that you didn’t know you couldn’t use an open bottle of propofol,” the judge told the doctor.
