Donald Trump continues to be deprived of his victory in the November 3 presidential election by massive fraud. “The election was totally rigged,” Trump said again Monday at a White House ceremony. Trump and his Republicans not only failed to provide proof of this. Even Attorney General William Barr, a close confidant of Trump, sees no evidence of this. Despite Trump’s resistance, it all comes down to the fact that the winner of the Democratic election, Joe Biden, will be sworn in as the 46th president of the United States in just over six weeks. What is “safe haven” about?
The “safe harbor” deadline expires on Tuesday (today), the “safe harbor” deadline. If states have reported their certified results to Washington by then, they will be considered “final” by the US Congress, parliament. So unlike the case of results that are still controversial in the states themselves after this period, Congress can no longer influence these results. However, this period is not binding on the states. Furthermore, should the results be controversial in a state, Congress could theoretically decide who its constituency is directed to. The deadline is a consequence of the controversial presidential election of 1876, after which several states reported conflicting results.
Are the results already certified in the main states?
The six particularly controversial states have already certified the results; in all of them Biden and his second candidate Kamala Harris have won. Georgia was certified on November 20 (and again on Monday), Michigan and Pennsylvania on November 23, Nevada on November 24, Arizona on November 30, and Wisconsin on December 1. That didn’t mean that no legal action could be taken afterward: Trump’s team took legal action against the results even after the certifications, but so far they have not been successful. Have Trump’s demands changed anything so far?
No, not in a single case. Trump attorneys and supporters have filed dozens of lawsuits in Georgia, Michigan, Pennsylvania, Nevada, Arizona and Wisconsin. Most of them have been rejected or discarded and some are still pending. It was the fact that certain votes were not allowed to be counted or that certain deadlines for voting by mail were illegal. Also, the vote counts requested by Trump’s team did not change the results in the states. Despite the failures, Trump continues to insist that there has been an enormous amount of fraud.
What’s next now?
On December 14, six days after the “safe harbor” deadline, the electorate meets in the respective states. Each electoral representative casts one vote for the president and one for the vice president. These votes are listed, certified, sealed, and then transmitted to the President of the Senate (this function is performed by the Vice President of the United States, currently Mike Pence) and the Federal Archives in Washington. They must be received there before December 23. On January 6, the House of Representatives and the Senate will meet to count the votes of the states and announce the result. The winner is whoever can unite at least 270 of the 538 voters. According to preliminary results, Biden has 306 voters, Trump has 232.
Can Trump still win in the end?
Trump and his close allies claim this, but experts see no realistic possibility for it. Even if one of his demands were successful: given Biden’s advantage, it wouldn’t be enough if Trump could override the result in just one state like Georgia, for example; Biden would still have more than enough votes.
