Terrorist attack in Vienna: citizen initiative prepares civil liability lawsuit

The first legal steps are now due to the setbacks surrounding the attack in Vienna: the citizens’ initiative “Wir im Erste” is preparing a lawsuit for official responsibility, its founder and lawyer Karl Newole announced on Friday.

“There is sufficient evidence of the responsibility of the State in the context of the so-called official responsibility. If the lawyer had acted correctly, the attack would have been avoidable,” says the lawyer. By the way, Newole was a member of the cabinet of former SPÖ Interior Minister Karl Blecha (1983 to 1989), who resigned over the Lucona and Norica affairs.

Some of the injured parties have already asked about the citizens’ initiative, Newole says. These are the survivors of the victims, the injured and those who suffered material damage on Monday’s night of terror.

“Official responsibility is understood as the responsibility for damages caused by state bodies in the exercise of their official activities due to illicit and culpable conduct or omission,” he explains. According to the lawyer, damages for funeral expenses, bereavement and collision damages, maintenance of surviving dependents, compensation for pain and suffering of injured persons, compensation for disability, lost profits or property damage could be considered.

If there is a court case surrounding the night of terror, the legal responsibility of state bodies will be clarified, possibly down to the ministerial level, Newole said.

There is no information on the purchase of ammunition.

Interior Minister Karl Nehammer had been under pressure in recent days when it emerged that later assassin Kujtim F. had tried to buy ammunition for an AK-47 in Slovakia. The Slovak authorities were in contact with the Austrian authorities, but the Office for the Protection of the Constitution did not transmit this information to the judiciary.

The country’s leading lawyers confirm that the attempted purchase of arms was a motive for the arrest of Kujtim F. He had already been sentenced and suspended for his involvement in a terrorist organization. (see report below).
