On Monday, 1,500 people demonstrated against the Corona measures in the center of Vienna. Although there were numerous violations of the Covid-19 law, the demonstration was tolerated. Apparently, it is not clear who was responsible for the dissolution.

After the demonstration against the corona measures, on Tuesday the discussion continued on whether the police or the city’s health authority (MA 15) would be responsible for the dissolution due to serious violations of the Covid-19 Measures Law. No consensus was reached at a meeting that was also attended by representatives of the Ministry of the Interior.

After the anti-crown demonstration in Vienna, there is legal uncertainty

Around 1,500 protesters demonstrated in the city center on Monday afternoon. The minimum distance was not kept, most of the protesters did not wear masks either. The participants did not obey requests from the police.

LPD Vienna takes the legal position that in the face of a possible early ban, which would be very difficult anyway due to a VfGH decision, or a dissolution for epidemiological reasons, the Vienna City Magistrate would be responsible as the health authority. The execution, in turn, would be assumed by the executive. The city, on the other hand, sees no responsibility on its side. Consequently, no agreement was reached during Tuesday’s meeting.

Demo participants were not shown

No complaints were made against individual participants during the demonstration, as practically all of them did not comply with the guidelines. As the demonstration did not dissolve, it was tolerated.
