It was eagerly awaited and a long time to arrive: four hours before its planned entry into force, the new Crown ordinance of Health Minister Rudolf Anschober (Greens) had not yet been published.
This sparked massive anger among the opposition. The deputy The head of Neos, Nikolaus Scherak, spoke of a “regulation whose content nobody knows and cannot know”. The SPÖ was outraged, as reported by the KURIER, especially over the fact that the federal states led by the ÖVP had already received the draft regulation on Monday. “Define amateurism or show politics instead of crisis management,” SPÖ party leader Pamela Rendi-Wagner tweeted.
The ordinance is already there and can be viewed by the public in the federal legal information system. However, the regulation will only go into effect on Sunday, October 25. The distance of 1 meter is behind, there is an outdoor alcohol hardening, the face visors have a defined expiration date.
Lawyer: “You have to question”
The jurist Dominik Prankl in an initial assessment: “The distance of 1 meter is allowed this time because it is covered by the current Covid Measures Law.” As a reminder: the Constitutional Court tipped the baby elephant in July. And it was Prankl who made his complaint. The complaint made the difference.
In general, attorney Prankl has concerns: “You have to question why these regulations apply again to the entire federal territory, although some areas are still green.”
