The Ministry of Justice is currently examining whether the age of marriage in Austria should not generally be raised to 18 years. A marriage ban for cousins is also being considered, Justice Minister Alma Zadic (Greens) said Thursday at the National Council’s Human Rights Committee.

The project can also be found in the turquoise green government program, the ÖVP had promoted it in the election campaign of the National Council and had campaigned against forced marriage. As Zadic explained according to parliamentary correspondence in the committee, currently marriages in Austria can only be concluded at the age of majority. However, the court can also declare 16-year-olds of legal age under certain conditions.

Individual exams for minor marriages

According to the Minister of Justice, this provision is now under review, especially since it does not apply to registered partnerships. In the case of marriages of minors celebrated abroad, there are individual examinations.

Address application reform

Other issues in the discussion with the minister were the duration of some judicial processes, the imposition of preventive detention for violations of quarantine requirements or the government’s initiative against online hate. In the course of budget negotiations, Zadic wants to campaign for an increase in the fees for interpreters and court experts.

The long-awaited reform of the application of the measures will be divided into two parts, and an amendment to the Housing Law should be available before the end of the year.
